Warranty Terms and Conditions E-Motion Warehouse
At E-Motion Warehouse, we’re committed to supporting our customers and standing by the quality of our e-bikes and accessories. Our products come with guarantees that can’t be excluded under Australian Consumer Law.
This means that you’re entitled to a replacement or refund for a major failure, and also to compensation for any other reasonably foreseeable loss or damage. If your product experiences a fault that doesn’t amount to a major failure, you’re entitled to a repair or replacement.
The warranty we offer is in addition to your statutory rights under Australian Consumer Law.
Warranty Coverage
E-Motion Warehouse warrants that our products are free from defects in materials and workmanship for the following durations (or up to 10,000 km, whichever comes first) from the date of purchase—or as otherwise stated on the product packaging. This warranty is valid only when the product is used as intended and in accordance with the instructions provided.

What’s Not Covered (Out of Warranty)
Some types of damage fall outside of our warranty coverage, including but not limited to:

Damage caused by misuse, abuse, neglect, fire, collision, or riding in unsuitable conditions (e.g., through water or over large obstacles)

Theft, vandalism, or tampering

Damage from re-modelling or modification of the product

Cracking or damage from carrying excessive loads

Wear and tear from normal use, including:

Fading paint or finish
-
Rust or deterioration of metal, plastic or rubber

Flat tires, worn brake parts, torn stickers

Making a Warranty Claim
To make a claim, please return the product to the original store of purchase (or any store within the same retail group, if applicable), along with proof of purchase. The store will coordinate with E-Motion Warehouse or its service partners for inspection and action.
Depending on the circumstances, we may repair, replace, or refurbish the product at our discretion. The store will let you know when your item is ready for collection. Please note that shipping or handling costs involved in making a claim are your responsibility.
Indemnity
You agree to indemnify and hold harmless E-Motion Warehouse and its affiliates from any claims, losses, or legal proceedings—including reasonable legal fees—arising from:

Breach of these terms

Misuse or unauthorised modification of our products or software

Any violation of another party’s rights during your use of our products or services
Warranty Disclaimer
Apart from the product-specific warranties outlined above and those required by law, all E-Motion Warehouse products and services are provided “as is” and “as available.”
While we take care to provide quality service and support, we do not guarantee that:

Our products will meet every individual’s expectation or needs

Services or systems will always run without error, interruptions, or technical issues

Compatibility with specific third-party devices or services
Additionally, we cannot warrant that our systems or data servers are completely free from viruses or security threats—though we do our best to prevent them.
We are not responsible for losses, damage, or injury that may result from:

Events beyond our control

Acts of nature, vandalism, or misuse

Normal product aging or wear

Failure to follow operating instructions
Legal Rights and Additional Disclaimers
This warranty applies only to the original purchaser and is not transferable unless explicitly stated. Except where not permitted by law, E-Motion Warehouse excludes all other warranties—express, implied, or statutory, including merchantability or fitness for a particular purpose.
Where laws do not allow exclusion of implied warranties, some of the disclaimers above may not apply to you.
For our customers in Australia, this warranty operates in addition to your rights under Australian Consumer Law, which cannot be excluded. This includes your rights to remedies in case of product failure.
Limitation of Liability
E-Motion Warehouse’s liability is limited to the remedies outlined in this document, and we are not responsible for:

Any indirect or incidental damages

Loss of profits, data, or business

Costs related to alternate equipment or services

Content errors, third-party information, or misinformation
Our liability is limited to the typical and foreseeable direct loss, unless the situation involves wilful misconduct or gross negligence on our part.
This limitation does not apply to injuries, death, or health impacts where we are legally responsible. These terms are governed by the laws of New South Wales, Australia, and any disputes will be handled under the jurisdiction of New South Wales courts.
